Legal  & Regulations : Ownership for foreigners in Bulgaria. 

     1.Real Estate ownership

For Real Estate ownership we need to divide in 2 parts:

A)Citizens of EU countries and Companies from EU countries and from Member States under the European Economic Space Agreement (EESA) may buy and become owners of this type of property such as Bulgarians. There is no restriction for them. They may buy also house with land (for example yard of the house), or so called “regulated real estate” without any restrictions. 

 B)Citizens and Companies from non-EU countries (so called “third countries”) they may buy and become owners of this type of property such as Bulgarians. There is important restriction here – these foreign citizens and companies may not buy land in Bulgaria. This means that they may not buy for example the yard of the house and may not buy regulated real estates and may not buy parking place, which is on the land (not part of parking area in a building).

According to the court practice they may buy land just in one particular case: when they buy apartment, office or other property in a building and there is land, which is belonging part to this property (so called ideal part of the ownership right over the land, where the building is situated).

 

These foreigners from third countries may buy land (non-agricultural land) if they register a Company under the laws of Bulgaria – Bulgarian company. For ownership over agricultural land however there is another regulation that we can provide you when you have interest to buy.

 

     2.Agriculture land

For agriculture land there are very specific regulations that we can provide when you show interest to buy it.

 All acquisitions of Real Estate / Land are made in front of the Notary with a notarial deed!

 The above mentioned is the basic provision of the Bulgarian law (end 2021), concerning the real estates and requirements for the foreigners to have real estates in Bulgaria and was provided to us by one of our law companies we work together with.
