The main task of a real estate agent is the contractual mediation between buyer and seller for the realization of a real estate transaction.

The legal variants of the contractual relationship between a real estate company / broker and his client / customer (direct party to a purchase or rental agreement) can differ. These can be:

- an agreement for mediation;
- contract for execution;
- an agreement with commission;
- open contract with mixed characteristics

 

Sometimes the customer does not realize the risks of such a deal, especially when purchasing. Sometimes they think they can handle it alone or with the help of friends who have "already gone this way". But you should keep in mind that the chances of encountering a property with perfect documents and correct sellers are very small.

Finally, in order not to become the owner of a property with serious problems or the victim of real estate fraud, the role of the broker or consultant is to protect you from malicious parties. 

The mediation service is not the performance of any work, but the realization of a specific result desired by the parties - the achievement of the desired result by mediating between the two parties.

The actual activity of finding contractors and preparing to close a real estate transaction is a time consuming process involving market research, visits, financing options, document collection and updating, inspections, which defines mediation as a contract with long-term performance.

MyVision may enter into brokerage assignments with its clients (as well as related agreements, attachments and other documents related to the performance of brokerage activities) remotely via email, other electronic communications, courier, post or fax. As an intermediary in real estate transactions, MyVision acts as a guarantor when concluding the preliminary purchase and sale contract of the real estate or the lease contract  for the real estate. MyVision undertakes, in view of its capacity as an intermediary, to assist the parties in finding mutually beneficial solutions to disputes and in resolving these disputes, but cannot guarantee the fulfilment of the parties' obligations under the contracts entered into and is not responsible for their non-compliance.

In the event of non-compliance with the agreements from the concluded preliminary and/or final contracts or lease agreements, the parties can claim their rights under the general claim procedure, if they have not reached an agreement among themselves. The brokerage agreement is an absolute commercial transaction, i.e. it is considered a commercial transaction whether or not the persons entering into the transaction are registered as merchants. The rules for mediation are subject to Commercial Law Art. 49 - art. 515, but applicable to everything not regulated therein, the general provisions of the law on obligations and contracts under art. 288 of the Commercial Code.

   In real estate transactions, for example, the demand parameters of the buyer or tenant are often broadly formulated and the intermediary's fee is usually not a fixed amount but defined as a percentage of the sale price or, for example, half of the rent.

 The Legal basis for concluding the mediation agreement as a bilateral transaction is in the interest of each of the parties in concluding it. The mediator does not act on behalf and for the account of the direct party to the transaction, but merely binds and prepares both parties.
